U.S. Supreme Court nominee Judge Brett Kavanaugh shares with the last high court nominee, Neil Gorsuch, a similar judicial philosophy, time on an appellate bench and even the same Washington-area prep school. But they are light years away from each other in the number of times they had to step aside from cases that came before their circuit courts.
Kavanaugh, a judge for 12 years on the U.S. Court of Appeals for the District of Columbia Circuit, reported 145 recusals—a far cry from Gorsuch’s 1,095 during his decade on the Tenth Circuit. The number of Kavanaugh’s recusals more closely mirror those of Justice Sonia Sotomayor, who reported 129 recusals in her nearly 11 years on the Second Circuit.
