A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit, including Chief Judge Merrick Garland, grappled with that question Friday. The case was brought by a group of locksmiths attempting to hold the companies behind Google, Yahoo, and Bing Maps liable for plotting sham locksmith operations on their mobile mapping applications.
