The U.S. Court of Appeals for the Eighth Circuit on Tuesday narrowed an injunction that blocked an Iowa law preventing schools from imposing mask mandates, but also determined that parents and students challenging the law will likely succeed.
A divided panel, including Judges Duane Benton, Jane Kelly and Ralph Erickson, ruled that a district court judge’s preliminary injunction stopping enforcement of the law was overly broad. The injunction now only applies to schools that serve the families behind the litigation. Disability support organization Arc of Iowa and 11 parents on behalf of their children with disabilities sued Gov. Kim Reynolds and its Department of Education director in September 2021, alleging the law passed by the state’s legislature last year violates federal disabilities law.
