A former Miss Universe winner will get her day in court against a Puerto Rican company that allegedly failed to pay her for a promotional deal, the U.S. Court of Appeals for the First Circuit has ruled.

The unanimous federal panel revived plaintiff and 2006 Miss Universe winner Zuleyka Rivera’s suit against Kress Stores of Puerto Rico Inc. and Mark Berezdivin after the U.S. District Court for the District of San Juan dismissed the case in August 2020 for failing to state a claim under Federal Rule of Civil Procedure 12(b)(6).
